26-year-old Justin Miller drove slowly through downtown Nashville just before midnight on Friday as a motorcycle officer attempted to pull him over for a traffic infraction with full emergency lights and sirens. Officers pulled next to him in the slow traffic, which was often at a standstill, and Miller taunted the officers, rolling down his window and yelling they couldn’t stop him, and even if they didn’t he wasn’t getting out of his vehicle. This went on for several blocks, through several traffic lights, and as Miller would move his vehicle forward, so would the motorcycle officer.
Eventually, the officer walked over to the car while stopped at a light and reached inside the window as he rolled it down to say he wouldn’t comply, and unlocked the door and opened it. It took the assistance of several other MNPD officers to pull Miller from his white Honda, as he actively resisted being removed. Eventually, he was taken into custody and charged with evading arrest in a motor vehicle (at 5 mph), and resisting arrest. He is free on a $10,000 bond.

ARREST WARRANT / AFFIDAVIT: |
On 11/12/2021 at 2345 Officers were on Broadway directing traffic to prevent backups. A police motorcycle and officer were being used to direct the cars. The Officer was manually directing the curb lane to pull forward. A white Honda insight was directly behind the police motorcycle in the center lane. The motorcycle had all its lights activated. Once the curb lane traffic began to move forward as directed the white Honda pulled in front of the moving traffic. The driver of the white Honda had his window down. As the Honda pulled into the moving traffic he was instructed to back up. He backed up then pulled in front of the traffic two or three times. When the traffic in the curb lane in front of him cleared he accelerated blocking the cars that were given direction to pull forward. At that point, the officer attempted to stop the vehicle at Rep. John Lewis Way and Broadway. The driver ignored the marked motorcycle with lights and sirens. The officer was able to pull next to him and give him a verbal command to stop his vehicle but he did not. The driver accelerated more and drove away from the officer attempting to make a traffic stop on his vehicle. When the driver got to the Demonbreun red light he was stuck in traffic. His window was still down and said you can stop me and that he would have to be removed from the vehicle. At that point, he rolled his window up. When the traffic would move forward so would he. When the subject was being arrested for evading arrest. When officers approached his vehicle he rolled the window up and refused to exit the vehicle. While he was refusing to exit the vehicle he kept rolling the window part way to tell officers he was not going to comply. At one point an officer reached inside the vehicle and unlocked the door and opened it. The subject still refused to exit the vehicle. At that point, two officers had to remove the subject from the vehicle. While being placed into custody he was using force to keep his hands and arms in front of his person refusing to place his hands behind his back. The subject was eventually taken into custody. |
