50-year-old Nashville Lawyer Benjamin Ashley Hodges was found in a South Nashville drive-thru just after 2:30 a.m. Wednesday morning, according to police. He was reportedly in a Toyota Yaris, hanging out of the driver’s side window yelling at the vehicle behind him in line. He would eventually blow a .226 on a breath test.
Metro Nashville Police responded to the McDonalds at 2212 Nolensville Pike at 2:32 a.m. Wednesday, for a reported intoxicated person being disorderly in the drive-thru. Officers say they found Benjamin Hodges hanging out the window of his vehicle yelling, upon their arrival.
An arrest warrant details Hodges showed multiple signs of impairment, including a ‘severe slur’ when he spoke, and reportedly smelled of alcohol. Officers conducted field sobriety tests, of which they report shoed indicators of impairment. A breath test resulted in a 0.226 BAC. Hodges was booked into the Metro Nashville jail and later freed on pre-trial release.
Hodges did not respond to a request for comment on this story.
