[GUILTY] Stalking – Aggravated
On 10/6/2015, officers were dispatched on a domestic disturbance. The defendant had been at xxx S 13th St, a residence that he is not allowed to be at due to an active order of protection. The defendant has been arrested five (5) previous times for violating the order of protection at this location (607 S 13th St). I have, on multiple occasions, personally observed the defendant walking on S 13th St, near the residence. He is aware of the order of protection and has acknowledged that it is in affect while speaking to me. On today’s date, his grandmother, the witness, stated he was sitting on her lawn furniture in her front yard. The victim, his 4-year old niece, was at the residence when the defendant was on the property. He left the location before officer’s arrived on scene. At the time of this newest offense, the victim was still protected by the active order of protection. Based on the witnesses’ statement, the five (5) previous order of protection violation arrest’s, and my personal observations that the defendant is still staying in the area and not attempting to avoid the residence, he was taken into custody.
OFFICER’S WERE DISPATCHED TO 607 S 13TH STREET, ON 9/24/15 AT APPROXIMATELY 0115 HRS, AFTER THE DEFENDANT CALLED INTO DISPATCH AND ADVISED THAT HE WAS VIOLATING AN ORDER OF PROTECTION. UPON OUR ARRIVAL, THE DEFENDANT WAS DRINKING A CAN OF BEER AND WAS VERY INTOXICATED. DUE TO THE DEFENDANT BEING 20 YEARS OLD AND CONSUMING ALCOHOL IN OFFICER PRESENCE, HE ‘S BEING CHARGED WITH UNDERAGE ALCOHOL CONSUMPTION.
Nonemergency 911 call
at approximately 11:15 p.m. officers were dispatched to xxx S. 13th Street due to the defendant calling 911. When officers seen the defendants name in the call text, they knew who he was due to several calls that the defendant had made in the past. Officer took the defendant to Mobile Crisis so he could talk to one of the workers at that location. After talking to Mobile Crisis officer then transported the defendant back to his house. On the way the defendant stated “that he wanted to go to jail and that he was going to call 911 as soon as he got out of the police car”. Officer then advised the defendant that it is against the law to call 911 for a nonemergency and if he did, he would be arrested. The defendant stated that he knew that it was against the law and he wanted to go to jail. Once officer arrived at his house and let him out of the police car the defendant immediately dialed 911 and told the dispatcher his name and address then hung up. The defendant then called 911 again and hung up. At that point officer took the defendant into custody without farther incident.
